1. Agreement to Terms

These Terms of Service (“Terms”) are a binding agreement between you and WhatSongIsThis (“we,” “us”) governing your use of the WhatSongIsThis website and song identification service (the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use it.

You must be at least 13 years old to use this Service. If you’re under 18, you confirm you have a parent or guardian’s permission.

2. Service Description

WhatSongIsThis is a free tool that identifies songs from:

• An uploaded audio or video file.
• Live audio recorded through your device’s microphone.
• A pasted YouTube, Instagram, or TikTok link, from which the audio is extracted automatically.

A successful match returns a title, artist, and links to Spotify and Apple Music where available. There is no account system, no paid tier, and no separate app — the Service runs in your browser. It’s provided “as is” and may be changed, expanded, or discontinued at any time.

3. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, or in a way that infringes someone else’s rights.
• Upload or link to content you don’t have the right to have processed.
• Attempt to gain unauthorized access to our systems, infrastructure, or data.
• Use bots, scrapers, or automated tools to send excessive or abusive volumes of requests.
• Attempt to reverse-engineer, decompile, or extract the underlying matching logic of the Service.
• Upload files containing malware or other harmful code.
• Use the Service to build a competing product by systematically harvesting recognition results.
• Record or upload audio of another person without their knowledge where that would violate applicable law.

We may suspend or block access for anyone violating this section, without prior notice, and cooperate with law enforcement where legally required.

4. Intellectual Property

The WhatSongIsThis name, design, and underlying code are owned by us or our licensors and protected by applicable intellectual property law. You may not copy, modify, or create derivative works from the Service, or use our name or branding without permission.

Song titles, artist names, album art, and related metadata returned by the Service are the property of their respective rights holders, provided through our fingerprinting partner. We don’t claim ownership of that content, and a returned result doesn’t grant you any rights to the underlying recording.

5. Your Submitted Content

By uploading, recording, or linking to audio, you confirm you have the right to have that content processed for identification, and that doing so doesn’t violate anyone else’s rights or applicable law.

You grant us a limited, non-exclusive license to process your submitted audio solely to return an identification result. That license ends the moment your file is deleted from our servers — which happens immediately after your request completes, whether or not a match is found. We don’t retain, reuse, or license your content onward to anyone.

If you believe content processed through the Service infringes your copyright, contact Legal@whatsongisthis.net with a description of the work, evidence of ownership, your contact information, and a statement made under penalty of perjury that the information is accurate.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied — including that it will be accurate, uninterrupted, or error-free. Music identification is not guaranteed to be correct or complete: covers, remixes, unreleased tracks, and very new releases may not return a match, and results are dependent on a third-party fingerprinting catalog we don’t control. 7. Limitation of Liability

To the fullest extent permitted under the laws of Iceland, WhatSongIsThis is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on an inaccurate or missing identification result. [This section in particular should be reviewed by a lawyer to confirm it’s enforceable and appropriately scoped under Icelandic law.]

8. Termination

We may suspend or restrict access to the Service for anyone violating these Terms, without notice. Since there’s no account, “termination” in practice means blocking abusive access at the technical level. You can simply stop using the Service at any time — there’s nothing to cancel.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Iceland, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service is subject to the jurisdiction of the courts of Iceland, unless applicable mandatory consumer-protection law in your own country of residence provides otherwise.

10. Changes to These Terms

We may update these Terms as the Service changes. The “Last updated” date at the top will change when we do. Continuing to use the Service after an update means you accept the revised Terms.
